Rental Policy


RESERVATIONS:

Reservations may be made up to 1 year in advance. Your deposit is due by credit card, check, cash, or money order within 7 days of making the reservation. After 7 days if your deposit is not received in our office, your reservation will be dropped from our system. The dates will then become available to other customers.

No personal checks accepted 30 days prior to an arrival, or at check-in.
At the time of reservation, a 50% deposit is required.
All of our units have a security deposit of $200.00.
You may use a credit card or if you don't have a credit card, you must have a cash deposit, which will be refunded after the unit is checked and no damages are found and mailed back to you within 10 days.

Rates are subject to change unless confirmed. Keys will be given at check-in. There is a $35.00 charge for each set of keys lost or not returned. This is for guests protection.

A minimum stay of 2 nights is required (4 nights on holidays and October, some cabins only rent by the week). Check-in is at 3:00 pm, no earlier unless prior arrangements have been made.

Check-out is 11:00 am, no later. A minimum of $100.00 will be charged for late departures unless you have permission from the office.


Cancellation Policy:

Refunds on Cancellations Within 21 Days of Arrival:  If you purchased trip insurance and cancel or reschedule within 21 days of your arrival date for a covered reason, we will email you a statement of account to assist you in filing a claim with Travel Guard.  Claims may be filed by calling 1-888-409-7749 at which time they will let you know what additional documentation (like a doctor's note) is required for processing.  If you did not purchase trip insurance or your reason for cancellation is not covered by the policy, then your deposit will be charged for any dates of your original reservation that we are unable to resell.  Any remaining balance will be refunded to you by check less a $50 cancellation fee.

Refunds on Cancellations More Than 21 Days Prior to Arrival: If you cancel or reschedule more than 21 days prior to your arrival date, your deposit will be refunded by check less a $50.00 cancellation fee.  You may leave your deposit on file and apply it to another reservation once without incurring the fee within the same calendar year.  If you purchased trip insurance and cancel between 22 and 30 days prior to arrival for a covered reason, the trip insurance can by used to recover the cancellation fee.

To cancel or reschedule, you must contact us by phone during normal business hours and receive a cancellation number.  If you attempt to cancel by email, do not assume your reservation has been cancelled unless we return your email with a cancellation number because your email may not have been received.  We are not responsible for delays in cancellations caused by email problems and cancellations received after hours will be counted as received on the next business day. 

All rescheduling is subject to availability and pricing adjustments for the day of the week, seasonal rates and special events.  All refunds will be made by check payable to name on the credit card or checking account.  There are no refunds for early departure, and all deposits placed on file will be forfeited if not used within one year.
 
 
General Policies:

You must be 21 YEARS OF AGE or over to rent a cabin.

NO WILD HOUSE PARTIES are permitted.

All cabins are NON-SMOKING cabins.

No Pet’s Allowed.

Misty River will not assume responsibility for road conditions to and from the cabin during inclement weather. The cabin offers easy access. Unless US-HWY 321 is closed you are still responsible for your stay and no refunds will be made. There are no steep mountain roads to travel to reach the cabins so road conditions are not much of a factor for canceling reservations as it could be with other cabin rentals. 

Misty River Cabins & RV Resort is located on the Little River and if you go into or next to the river you do so at your own risk. If you use the pool or hot tubs, you do so at your own risk. We do not provide life guards at the pool, hot tubs or the river.

Firewood is not provided.

Our owners love their homes and would appreciate you treating it like it was yours. Do not remove anything from the unit or do any damages. You will be charged for them. Please do not move furniture, if you move furniture and we have to move it back, you will be charged. Please leave unit as you found it. If the unit is left excessively dirty, there will be a cleaning fee. 

All linens are provided including bed linens, bath towels, hand towels and washcloths. The cabin has been stocked with a starter supply of soap, garbage bags, dishwasher detergent, toilet tissue and paper towels. Any other supplies are the responsibility of the guests.

Wildlife may be present in the area. Please DO NOT leave food out for these animals. It is for their protection as well as your safety that they do not eat human food. Please enjoy them from a safe distance and never attempt to hand them food or photograph them up close.

Upon your departure, the housekeeping staff will clean your cabin. This is included in your rental fee. We ask that you leave the kitchen clean, put the dishes in the dishwasher and start the machine, collect your trash and put it in garbage bags and put all dirty towels and washcloths in basket provided in bathroom. Please lock all windows and doors and return your keys to lockbox.
 
Misty River is not responsible for personal items left behind.

Misty River Cabins & RV Resort tries to do everything possible to keep all equipment in working order, however it is impossible to guarantee that all appliances, Hot Tubs, Heat & air, Hot water heaters, ect. will be in working order 100% of the time. We will repair the problem as soon as possible during normal business hours, there will be no refunds for breakdowns or malfunctions of these or no refunds for electrical or cable outages. If your unit has satellite TV and you are confused about how to use it, we will be happy to assist you by phone, however if you insist we send someone to the unit and we find the problem is due to your error, there will be a $25.00 charge. 

Hot Tubs are cleaned and sanitized before and after each rental. Covers should be left on Tub at all times when not in use. Children under 16, pregnant women, persons with heart conditions or skin sensitivities should not use Hot tub. DO NOT STAND ON COVER, IT WILL BREAK AND YOU WILL BE CHARGES FOR A REPLACEMENT 

Our cabins are privately owned and decorated with the owners' furnishings. It is uniquely decorated and expresses the personality of its owners. Neither Misty River nor the owners shall be responsible for providing any additional furnishings. Equipment failures will be repaired as quickly as possible after being reported to the office. Local telephone calls are free.

INSECTS:
 
Each unit is professionally treated regularly by a licensed pest company, however we are in the mountains and occasionally unwanted guests do make their way inside. Please sweep up any dead insects or call the office if you have live insects and we will have the pest company take care of it.
SECURITY DEPOSIT 
 
Guest are responsible for any damage the cabin experiences during their stay that is done by the guest, weather accidental or intentional. Guest will be charges for the damage, such as holes in walls, stains in the carpet, broken furniture or missing items, ect. Cabins are inventoried before and after each guest. Guest will also be held responsible for any maintenance bills incurred due to guest negligence, such as: Diapers, sanitary napkins, etc. flushed in toilet. Dish washing detergent run in the dish washer instead of dishwasher powder. Damage to hot tubs and/or hot tub cover. All Furniture, appliances, electronics and game equipment must not be moved and kept in the same condition as upon arrival. If the cabin is excessively dirty then the guest will be charged for an additional cleaning fee. 
 
I have read the above statements. I agree to be responsible for the cost of any damages and/or additional cleaning fees incurred during my stay. I understand that the credit card will be only be authorized not charged unless damage occurs. 

Trash Container MUST BE CLOSED AND LATCHED AT ALL TIMES. ANY CITATIONS RECEIVED DURING YOUR STAY WILL BE CHARGED TO YOUR SECURITY DEPOSIT.

The policy costs 7.0% of your total room reservation and we recommend you purchase the insurance at the time of booking to ensure the best coverage. Q. Why should I purchase travel insurance for my vacation?
A. You've saved, you've waited, and now you're all set to travel. Preparing for your trip includes covering  yourself for unfortunate occurrences that can interfere with even your best-laid plans. By purchasing a travel insurance plan, you can insure yourself for covered cancellation penalties, medical costs, as well as gain access to a wide range of traveler's assistance services.


Did you know that the All Seasons Travel Plan could cover you if:

• Someone in your family suffers an illness or injury, even if they aren't scheduled to travel with you

• You become ill and can't travel or your child comes down with the chicken pox and you are quarantined

• You or a traveling companion loses a job and you or they have been with the employer for at least one year

• Weather prevents you from leaving home and reaching your destination

• A family member passes away and you must return from your vacation early

• Your luggage or sports equipment is lost or delayed by the airline

What are the coverages?


• Trip Cost - Trip Cancellation & Interruption (covers trip costs up to $100,000)
Per Booking Coverage Covers your trip investment if you must cancel or interrupt your trip due to covered reasons such as sickness, injury or death to you, traveling companion, family member, business partner or service animal; inclement weather; mechanical break down of a common carrier, being subpoenaed or required to serve jury duty, being called into active military service or having leave revoked or be reassigned, involuntary termination of employment or layoff; your principal residence or destination being made uninhabitable; pregnancy or childbirth.


• $600 - Trip Delay ($200 per day)
Per Person Coverage
Reimburses for the purchase of essential items (i.e. meals, hotels, etc.) if delayed for 6 or more hours because of a carrier caused delay, lost/stolen passport, travel documents or money, quarantine, natural disaster, injury or sickness of the insured or a traveling companion or the Insured being involved in or delayed due to a traffic accident while en route to a departure as substantiated by a police report.


• $250 - Missed Connection Per Person Coverage
Reimbursement for additional transportation expenses and unused prepaid, non-refundable trip payments if you miss a trip departure because of cancellation or delay of 3 or more hours of all regularly scheduled airline flights due to Inclement Weather or Common Carrier caused delay.


• $1,000 - Baggage Delay ($200 per day) Per Person Coverage
If your baggage is delayed for more than 12 hours, you will be reimbursed for the purchase of essential items (i.e. clothing, toiletries, etc.)

• $1,000 Baggage, Sportsman Equipment and Personal Effects Loss Per Person Coverage  Reimburses you if your baggage is lost, stolen, or damaged while on your trip.


• $25,000 - Medical Expense ($1,000 Dental)  Per Person Coverage
Covers emergency medical expenses incurred while traveling; includes emergency dental treatment.


• $500,000 - Emergency Evacuation & Repatriation of Remains  Per Person Coverage
Covers evacuation and transportation to the nearest adequate medical facility (or home in the event of death
or if medically required) as well as a medical escort if deemed necessary.


• $100,000 - Accidental Death & Dismemberment  Per Person Coverage
Covers death and loss of limb or eyesight within 180 days of an accident.


• $25,000 – Car Rental Collision Coverage  Per Car Coverage
$25,000 in primary coverage! Covers cost of repairs for damage due to covered reasons to a rental car, up to the limit of coverage, for which the car rental contract holds you responsible.

Q. Are the benefits listed per insured or per booking?
A. The benefits for Trip Cancellation and Trip Interruption are the total per booking. For example if the insured purchased travel insurance coverage for a trip costing a total of $2,000, this would be the maximum reimbursement allowable under trip cancellation or interruption for that booking. All other coverages are per person with the exception of the Car Rental Collision Coverage which is per car coverage.

Q. Will my current homeowners, renters, credit card, health or insurance policies cover me during my trip?
A. Other insurance may not provide coverage while you travel due to coverage provisions, limitations, exclusions and restrictions. Many people don't have any insurance coverage at all if they must cancel their trip. This insurance plan has a wide range of travel benefits; which credit card, homeowners, and renter’s insurance may not provide. The medical expense coverage included in this insurance plan is vital for people  whose health insurance plans may not pay for medical expenses incurred outside of the United States (e.g., Medicare, certain HMO's, etc.) This coverage in this plan is primary.

Q. I know that I have a pre-existing medical condition; will the plan cover me?
A. Even if you have a medical condition that has been unstable in the last 60 days, you should still consider purchasing this insurance plan because the Pre-Existing Condition exclusion will be waived if you purchase the plan within 21 days of your initial deposit. As long as you are medically able to travel at time of purchase,having the Pre-Existing Condition exclusion waiver is the easiest way to help alleviate doubt as to coverage
due to chronic medical conditions. There are some conditions that are not included in the exclusion wiaver such as anxiety related mental or nervous disorders. Please see the Exclusions section of the Description of Coverage to view these conditions.


Q. One of the covered reasons listed under trip cancellation is “Sickness, Injury or death of an Insured, Family Member, Traveling Companion, Service Animal or Business Partner”. What is the definition of a Family Member, Business Partner and Service Animal?

A. The family member definition means the Insured’s or Traveling Companion’s spouse, Domestic Partner, Child, daughter-in-law, son-in-law, brother, sister, mother, father, grandparents, grandchild, step-child, stepbrother, step-sister, step-parents, parents-in-law, brother-in-law, sister-in-law, aunt, uncle, niece, nephew, legal guardian, Caregiver, foster child, ward, or legal ward.

The Business Partner definition means a person who: (1) is involved with the Insured or the Insured’s Traveling Companion in a legal partnership; and (2) is actively involved in the daily management of the business. The Service Animal definition means any guide
dog, signal dog, or other animal individually trained to work or perform tasks for the benefit of an individual with a disability, including, but not limited to, guiding persons with impaired vision, alerting persons with impaired hearing to intruders or sounds, providing animal protection or rescue work, pulling a wheelchair, or fetching dropped items.

Q. Given the current economy, what if my spouse loses his/her job?
A. The All Seasons Travel Plan includes coverage for trip cancellation/interruption due to involuntary termination or layoff which occurs more than 14 days after an Insured’s effective date of coverage. Only one year of employment with the same employer is required. If you or one of your traveling companions loses a job through no fault of your or their own and you need to cancel or interrupt your trip, this plan can provide reimbursement of non-refundable pre-paid travel expenses.

Q. What if I need transportation due to medical reasons and I am unable to get prior authorization from Travel Guard?
A. We always instruct our customers to contact local medical services during an emergency for immediate medical attention, or evacuation if necessary, and then notify Travel Guard as soon as is reasonably possible.
Payment arrangements for your evacuation will depend on the nature of your particularsituation and should be discussed with Travel Guard.

Q: Will my vacation be covered if I must cancel due to a hurricane?
A: You will have coverage if the property that you are scheduled to be staying at is inaccessible or uninhabitable within 30 days after the named hurricane causes the damage.

Q. Is there help while I'm traveling?
A. One of the valued benefits offered in this insurance plan is the 24-Hour Emergency Assistance Service.

Travel Guard is a leader in this field. With Travel Guard, you have access to the services of a highly trained, multi-lingual staff around the clock to assist you with such emergencies as cash transfers, lost documents, medical or legal monitoring, and referrals. They are also equipped to respond in many unexpected circumstances. If an emergency should arise during your trip, call Travel Guard immediately and give the details of your problem or medical emergency.

Q. Where can I call for more information?

Q. When is the latest the insurance plan can be purchased?
A. The plan can be purchased up until the final trip payment is made or 30 days prior to arrival, whichever comes first. If a booking is made within 30 days of the scheduledarrival date, the guest can purchase the insurance plan the day of the booking only.

Q. How do I file a claim?
A. In the event of a claim, please notify your booking agent immediately. Then call Travel Guard at 1.877.249.5376 and refer to product #008573 P1 to start your claim.
This is only a brief description of the coverage(s) available under policy series T30337NUFIC.

The Policy will contain reductions, limitations, exclusions and termination provisions. Full details of coverage are contained in the Policy. If there is any conflict between the contents of this document and the Policy, the Policy will govern in all cases.
